The war in Iraq is but a formal pretext to legitimate a discourse whose true aim is to eliminate the international law system, in the same way that the invasion of Poland by the troops of the III Reich had the aim of ending the legality imposed by the French Revolution. The ultimate goal is to impose a global state of exception, in which "the sovereign" - the neo-conservative government of the United States - "decides on the exception". La guerra en Irak, no es más que un pretexto formal para legitimar un discurso que, en realidad, lo que pretende es eliminar el sistema de derecho internacional. De la misma manera que la justificación de la invasión de Polonia por la tropas del III Reich fue, en palabras de Goering, terminar con la legalidad impuesta por la Revolución Francesa. Es evidente que la finalidad de la guerra no es la democratización de Irak. Lo que se busca con esta guerra es contrario a cualquier forma del estado de derecho y las libertades civiles tal cual las conocemos. Se pretende crear una nueva categoría de personas que no estaría recogida en el derecho de gentes. Para conseguir todo esto, es necesario rovocar la caída del sistema de Naciones Unidas y retrotraer la cuestión a antes de 1928, al momento anterior a la Sociedad de Naciones. Bajo todas estas formas lo que se pretende es conseguir lo que Carl Schmitt denominaba un "estado de excepción", en que el "soberano es quien decide sobre la excepción". En este caso el "Soberano" se expresa en las fuerzas neoconservadoras que dirigen la Casa Blanca y los demás reconocen esa capacidad a través de la excepción. La excepción no es más que la destrucción del sistema de derecho internacional, destrucción cuyas consecuencias son una desestabilización permanente donde se pueda aplicar la ley de la fuerza, cómo solución a los conflictos.
