Crimes Against Humanity

Crimes against humanity are provided for under Title III, Preliminary Chapter, Section 2, Article 208.2 of the Criminal Code (Law No. 2003-025 of 13 June 2003) of the Republic of the Niger. See:

    In addition, the Republic of the Niger ratified the Convention for the Protection of all Persons from Enforced Disappearance on 24 July 2015. Article 5 of the said Convention stipulates:
      "The widespread or systematic practice of enforced disappearance constitutes a crime against humanity as defined in applicable international law and shall attract the consequences provided for under such applicable international law."
    In its turn, Article 171 of the Constitution of the 7th Republic states: "Treaties or agreements regularly ratified have, upon publication, a higher authority to that of the laws, subject for each agreement or treaty to its application by the other party."

    Genocide

    Genocide is provided for under Title III, Preliminary Chapter, Section 1, Article 208.1 of the Criminal Code (Law No. 2003-025 of 13 June 2003) of the Republic of the Niger. See:

    War Crimes

    War crimes are provided for under Title III, Preliminary Chapter, Section 3, Articles 208.3 and 208.4 of the Criminal Code (Law No. 2003-025 of 13 June 2003) of the Republic of the Niger. See:

    Jurisdiction

    According to Article 208.8 of the Criminal Code (Law No. 2003-025 of 13 June 2003) of the Republic of the Niger, Niger courts have jurisdiction over crimes against humanity, genocide and war crimes regardless of the place where they were committed. For offenses committed abroad by a Nigerian against a foreigner, the complaint of the foreigner or his family or the official opinion of the authority of the country where the offense was committed is not required.

    In addition, Article 208.8 of the Criminal Code states that crimes against humanity, genocide and war crimes are not subject to any statute of limitations. Other common provisions to these crimes are contained in Article 208.5 (common plan aimed at the commission of crimes against humanity and genocide), Article 208.6 (obedience to superior orders cannot constitute an exonerating circumstance) and Article 208.7 (no immunity from prosecution) of the Criminal Code.     International Criminal Court

    Rome Statute of the International Criminal Court: The Republic of the Niger signed the Rome Statute of the International Criminal Court on 17 July 1998 and deposited its instrument of ratification on 11 April 2002.
