Part VIII: Offences Against the Law of Nations, Article 62 of the Criminal Code of the Republic of Kiribati provides:
"62. (1) A person commits the felony of genocide if he commits any of the following acts with intent to destroy, in whole or in part, a national, ethnical, racial or religious group, as such-
(2) A person guilty of the felony of genocide shall on conviction-
(a) killing members of the group;
(b) causing serious bodily or mental harm to members of the group;
(c) deliberately inflicting on the group conditions of life calculated to bring about its physical destruction in whole or in part;
(d) imposing measures intended to prevent births within the group;
(e) forcibly transferring children of the group to another group.(a) if the offence consists of the killing of any person, be sentenced to imprisonment for life;
(3) Proceedings for an offence of genocide shall not be instituted except by or with the consent of the Attorney-General."

Jurisdiction Section 4 of the Geneva Conventions Act of Kiribati states:
"4. In the case of an offence under sections 3 or 3A committed outside Kiribati –
See:(a) a person may be proceeded against, tried and punished therefor in any place in Kiribati as if the offence had been committed in that place; and
(b) the offence shall, for all purposes incidental to or consequential on the trial or punishment thereof, be deemed to have been committed in that place."
