This HTML Database has been prepared by Equipo Nizkor and it focuses on the domestic implementation of International Criminal Law for the most serious crimes under international law i.e. crimes against peace (or the crime of aggression), crimes against humanity, genocide and war crimes. It provides access on a country-by-country basis to the relevant domestic legislation, as well as to applicable judicial decisions and jurisprudence.
The purpose of this open Internet database is to foster the application of international criminal law by domestic jurisdictions for these grave crimes. Reference to the applicable legislation should be understood without prejudice to the fact that application does not solely depend upon the legislative will of the States of the international community. The seriousness of these categories of crimes is such that in certain cases, even in the absence of domestic legislation, domestic courts may exercise jurisdiction. This could be the case when the crimes at issue are jus cogens crimes or if they are part of customary international law. |
