Resolution No. 1157 establishing an Interdepartmental Commission for the Implementation of International Humanitarian Law

On establishment of Inter-departmental commission for implementation in Ukraine of international humanitarian lawWith the view to impement international and legal obligations of Ukraine, resulting from the Geneva Conventions on protection of victims of war of 12 August 1949, their Additional Protocols and other international treaties on the issues of humanitarian law, the Cabinet of Ministers of Ukraine resolves:
1. To establish Inter-departmental commission for implementation in Ukraine of international humanitarian law in the structure, according to the addendum.
2. To approve the Regulations on Interdepartmental commission for implementation in Ukraine of international humanitarian law (attached).

Regulation
On the Inter-departmental commission for implementation in Ukraine of international humanitarian law1. The Interdepartmental commission for implementation in Ukraine of international humanitarian law (further Commission) is a permanently acting coordination body, established by the Cabinet of Ministers of Ukraine with the view to ensure implementation of international and legal obligations of Ukraine, resulting from the Geneva Conventions on protection of victims of war of 12 August 1949, their Additional protocols and other international treaties on the issues of humanitarian law.
2. The commission in its activity is governed by the Constitution of Ukraine, laws of Ukraine, acts of President of Ukraine and Cabinet of Ministers of Ukraine, international treaties of Ukraine, and current Regulation as well.
3. Principal objectives of the Commission are:
- To study and analyse legislation of Ukraine and prepare proposals, related to making it complying with the regulations of international agreements on the issues of international humanitarian law, where Ukraine is a participant;
- Coordination of activity of the ministries, other central and local authorities of executive power, self-management bodies, interested public organisations on the issues of implementation in Ukraine of international humanitarian law;
- Information and methodological assistance of activity of organs of state authorities, self-managing bodies, as well as interested institutions and organisations, connected with the implementation of international humanitarian law, promoting dissemination and elucidation of its rules.
4. The commission, in conformity to the objectives, vested in it: organizes preparation of projects of normative and legal acts on the issues of implementation in Ukraine of humanitarain law, conducting scientific research and expert evaluations, with this aim establishes sub-commissions, working groups;
- Considers draft projects of normative and legal acts on the issues of implementation in Ukraine of international humanitarian law, submits to the Cabinet of Ministers corresponding proposals on these issues;
- Takes part in development and implementation of measures, aimed to ensure performance of international and legal obligations of Ukraine, resulting from the Geneva Conventions on protection of victims of war of 12 August, 1949, their Additional protocols, and other international agreements on the issues of international humanitarian law, and in established order prepares proposals concerning conclusion of international agreements on the issue;
- Considers at its meetings information of heads of ministries, other central and local bodies of executive power on the issues of implementation in Ukraine of international humanitarian law;
- Submits in established order proposals related to abolition of decisions, taken by the authorities of executive power and organs of local self-management, institutions and organisations, contradicting the rules of international humanitarian law;
- Participates in established order in events, conducted by the international organisations, particularly seminars, conferences, meetings, etc., on the issues of implementation of international humanitarian law; Carries out control over execution of decisions, taken by the Commission.
5. Commision has the right:
- To receive in established order from the ministries, other central and local authorities of executive power, organs of local self-management, enterprises, institutions and organisations, a free of charge information, necessary for execution of objectives, vested in it;
- To recruit, in case of necessity, and in established order, for work in the Commission, executive employees of the ministries, other central and local organs of the execuitve power, prominent scholars, specialists of non-governmental organisations;
- To use technical assistance of international organisations to resolve issues, connected with implementation in Ukraine of international humanitarian law.
6. The Commission, performing its tasks, vested in it, maintains connections and exchanges information with corresponding organs of other states, International Committee of the Red Cross, other international organisations, carrying out activity in the area of international humanitarian law.
7. The Commission annually informs the Cabinet of Ministers of Ukraine of conducted work and about execution of international and legal obligations of Ukraine on the issues of implemenation of international humanitarian law.
8. Personal composition of the Commission is approved by the Cabinet of Ministers of Ukraine.
Amendments to personal and quantitative composition of the Commission are introduced by the head of the Commission, following application of heads of corresponding ministries, other central organs of the executive power, the Secretariat of the Cabinet of Ministers of Ukraine, National committee of the Ukrainian Red Cross Society, and other interested organisations.
9. The Commission is headed by the chairman, who officially is the Minister of Justice of Ukraine.
The chairman of the Commission:
- carries our management of activity of the Commission, and is personally responsible for fulfillment of objectives, vested in it;
- organises consideration of draft documents on the issues of implementation in Ukraine of humanitarian law, which are presented to the Commission; establishes in stipulated order sub-commissions and working groups of the Commission.
- determines agenda of the meetings of the Commission and time-limit of its work;
- represents Commission in relations with the authorities of executive power, organs of local self-management, enterprises, institutions, organisations, as well as with corresponding authorities of other states and international organisations, conducting activity in the area of international humanitarian law.
10. The chairman has a deputy, who is the chairman of the National committee of the Red Cross Society.
11. A meeting represents organisational form of the Commission's work. The meeting of the Commission is convened in case of necessity, but no less than twice a year.
The Commission is competent to resolve issues, if no less than two-thirds of its members are present at the meeting.
12. The representatives of organs of state power, local self-management bodies and interested public organisations may take part in the meetings of the Commission, as agreed by the chairman of the Commission.
13. The decisions of the Commission are adopted by the simple majority vote of members, present thereof, and are arranged by the record of the proceedings, signed by the chairman and the secretary of the Commission. The record of the proceedings of the Commission is sent to all members of the Commission within five days period from the day of the meeting.
The decisions of the Commission, adopted within the limits of its competence, are mandatory for consideration by the central and local organs of executive power, self-management bodies, enterprises, institutions and organisati ons.
14. The Commission has letter-heads of an established form with its title.
15. Organisational, logistic and financial provision of activity of the Commission is fulfilled by the Ministry of Justice of Ukraine.
