Regime for the Implementation of the Convention on the Prohibition of the Development, Production, Stockpiling and Use of Chemical Weapons and on Their Destruction

Decree No. 21

Article (1):

The Ministry of Foreign Affairs shall be considered the National Authority concerned with the implementation of the Convention on the Prohibition of the Development, Production, Stockpiling and Use of Chemical Weapons and on Their Destruction, and shall represent the Sultanate in the Organisation for the Prohibition of Chemical Weapons in The Hague.

A Committee shall be established in the Ministry under the Chairmanship of the Ministry's representative, consisting of a delegate from each of the Ministry of Regional Municipalities and the Environment and the Ministry of Defence. It shall be responsible for developing the rules and taking the measures necessary for the implementation of the Convention, and for supervising the work of the Follow-up Committee provided for in Article (3) of this Regime.

A decision shall be issued by the Minister of State for Foreign Affairs on the formation of this Committee and the organisation of its work.

Article (2):

The National Authority shall have the right to request any natural or legal person to supply it with any information concerning chemical industrial activities or the import or export of chemicals, as required for the implementation of the Convention.

It shall also have the right to conclude any bilateral agreement with the Organisation for the Prohibition of Chemical Weapons, in accordance with the provisions of paragraph 50, Article VIII of the Convention.

Article (3):

The Ministry of Regional Municipalities and the Environment shall be responsible for the implementation at the national level of the provisions of the Agreement.

By a decision of the Minister of Regional Municipalities and the Environment, in co-ordination with the Minister of State for Foreign Affairs, a Committee shall be established under the chairmanship of the representative of the Ministry of Regional Municipalities and the Environment, consisting of one delegate from each of the Ministries of Foreign Affairs, Defence, Commerce, Industry, Oil, Minerals, Health, Legal Affairs and the Sultanate Police of Oman. It shall follow up the implementation of the provisions of the Convention in the light of the rules and decisions issued by the Committee, provided for in Article ( 1) of this Regime, and shall co-ordinate the activities of all Government bodies and industrial facilities relating to the implementation of the Convention.

Article (4):

The Committee shall hold its meetings at the invitation of its Chairman, whenever necessary or pursuant to the request of the Committee provided for in Article (1) of this Regime.

Article (5):

For the purpose of implementing the provisions of the Convention, no person shall be permitted:

    (a) To develop, produce, stockpile, own or possess chemical weapons or to transfer them to any place.

    (b) To use chemical weapons.

    (c) To engage in any military preparations to use chemical weapons.

    (d) To assist or encourage engaging in any activity prohibited to a State Party under the Convention.

    (e) To transfer any chemicals listed in Schedule 1 or Schedule 2 of the Annex on Chemicals to anyone in a State nor Party or receive them from him, except in cases which are not contrary to the provision of sections "A" and "B" of Part VI or Section "C" of Part VII of the Verification Annex.

    (f) To transfer any chemicals listed in Schedule 3 of the Annex on Chemicals, in case such transfer is contrary to the provisions of Section "C" of Part VIII of the Verification Annex.

Article (6):

For the purpose of implementing the provisions of the previous Article, "chemical weapons" means:

    (a) Toxic chemicals and their precursors, except where intended for purposes not prohibited under this Convention, as long as the types and quantities are consistent with such purposes.

    (b) Munitions and devices, specifically, designed to cause death or other harm through the toxic properties of those toxic chemicals specified in the previous item.

    (c) Any equipment specifically designed for use directly in connection with the employment of munitions and devices specified in the previous item.

Article (7):

It shall be prohibited for anyone to disclose any information obtained through implementing this Regime on the Convention.

Article (8):

Anyone abstaining from providing the National Authority with any information required for the implementation of the Convention, or who provides it with incorrect information shall be punished by imprisonment for a period of not less than one month and not more than three years, and with a fine of not more than five hundred Omani Riyals.

Article (9):

Anyone violating:

    (a) Article (5) of this Regime, shall be punished by imprisonment for a period of not less than three years and not more than fifteen years, and with a fine of not more than fifteen thousand Omani Riyals. Seizure shall be imposed in all cases.

    (b) Article (7) of this Regime, shall be punished by imprisonment for a period of not less than ten days and not more than two years, and with a fine of not more than five hundred Omani Riyals.
