Amended Law of the Jordan National Red Crescent Society for the year 2009
We, Abdullah the second Ibn Al-Hussien, King of the Hashemite Kingdom of Jordan, according to Article (31) of the Constitution and to the decision of the Upper House and Lower House, endorse the following Law and order its legislation and to add it to the state's
Law no. (3) for the year 2009
Amendment of the law of the Jordan National Red Crescent SocietyArticle (1)
This Law shall be called the Amended Law of the Jordan National Red Crescent Society for the year 2009, and shall be implemented with Law no. 3 for the year 1969, referred to hereafter as the Original Law, and shall enter into effect as of its publication in the Official Gazette.
Article (2)
Clause (B) of Article (5) of the Original Law shall be cancelled and substituted with the following clauses:
B1- According to the stipulations of this Law, the word "emblem" means the emblem of the red crescent or red cross, as well as any other emblem that may be adopted based on an international convention effective in the Kingdom.
B2- The Emblem and its names shall be protected in times of peace and war, according to the stipulations of this Law.
C- Any person having committed the following acts shall be penalized by imprisonment for a minimum period of 3 months and a maximum of 3 years or shall pay a minimum of fine of JD100 and a maximum of JD 1000, or face both penalties altogether:
1- Deliberately or unrightfully using or naming the Emblem, or using or naming a symbol imitating it or that may lead to obscurity for any reason whatsoever.
2- Deliberately placing the Emblem on the boards of shops, stickers, publicity or commercials, commercial papers, commodities, wrapping or selling or promoting commodities using the Emblem.
D- If any entity commits the acts in Clause C, the penalties stipulated in the Penal Code shall be implemented against it, and the people who have committed the acts or ordered them in the name of the entity shall face the penalties stipulated in the same paragraph.
E- If any of the acts in Clause C are committed, the court shall order the elimination of it at the expense of the violator, and the confiscation or destruction of the seized material or any material used to commit the acts.
F- Anyone who uses or orders the use of the Emblem with deceptive intentions in times of war and armed conflicts in a manner that leads to serious damages to the health of people or their physical integrity shall be imprisoned with temporary hard labor for the minimum of 10 years. If the committed act leads to decease, the penalty shall be perpetual hard labor while observing more severe punishments mentioned in any other law.
G- The instigator and any accomplice in this crime shall face the same penalty as that of a perpetrator.
Article (3)
The Original Law shall be amended by adding (the following) Articles (40), (41) and (42), and re-numbering Articles from (40) to (43) to become from (43) to (46), respectively:
Article (40)
It shall be prohibited to register associations, trademarks, industrial and trade prototypes, drawings, or patents using any of the Emblems referred to in this Law or their names or using any emblem similar to any of them.
Article (41)
After this Law enters into effect, if any violations of its provisions were detected, violators are granted the maximum of three months to emend the committed violations. In the event that the perpetrator fails to emend the violations within that period of time, the penalties stipulated in this Law shall be imposed on them.
Article (42)
The Society's transferable and non-transferable funds, owned by the Society or used by it to accomplish its objectives, and all donations, grants or assistances given to the Society, no matter what their source is are exempted from all fees and taxes, including building and land taxes inside municipal areas and the general sales tax.
