Presidential Decree No. 246 on the Indonesian Red Cross Society
The President of the Republic of Indonesia
Considering :
a. that the Indonesian Red Cross Society is a national organization
which is founded on the principle of humanity and is, therefore, highly consistent with the State ideology of Pancasila;
b. that over the years, the Indonesian Red Cross Society has been demonstrating its work as a society which always provides voluntary assistance both for the general public and for government bodies;
c. that there has been no legislation on the Indonesian Red Cross Society up to the present moment and it is, therefore, deemed necessary to promptly stipulate a regulation on the Indonesian Red Cross Society, particularly as regards its status and duties;
Bearing in mind :
1. Article 4(1) of the Constitution;
2. Presidential Decree No. 25 of 1950 legalizing the Statutes of the Indonesian Red Cross Society, recognizing the Society as a corporate body, and designating the Society as the only organization to carry out the work of the red cross as meant in the Geneva Conventions in the Republic of Indonesia;
3. Law No. 59 of 1950 re the Republic of Indonesia Being Party to All the Geneva Conventions of 1949;
Hearing :
Deputy Prime Minister II, the Coordinating Minister for Defense/Security, and the Coordinating Minister for Welfare;
RESOLVES
To stipulate :

RE
THE INDONESIAN RED CROSS SOCIETYCHAPTER I
GENERAL PROVISIONSArticle 1
(1) The Indonesian Red Cross Society, hereinafter referred to as PMI, is a national organization which is founded on the principle of humanity and on the basis of voluntary service and makes no discrimination as to nationality, groups, or Political opinion.
(2) The PMI shall report to the Government on the implementation of its duties as mentioned in the PMI Statutes.
(3) The central leadership of the PMI shall report to the Deputy Prime Minister on the implementation of their duties as meant in Article 7 of the PMI Statutes.
CHAPTER II
CORE DUTIES AND ACTIVITIESArticle 2
(1) The PMI shall act on behalf of the Government of the Republic of Indonesia in the implementation of foreign relations in the red cross-related area to fulfill the requirements set out in the Geneva Conventions as regards the international community.
(2) Besides the duties referred to in paragraph (1) above, the PMI shall prepare itself for the implementation of duties, both at home and abroad, that are related to the provision of first aid in natural disasters that happen both at home and abroad, with the purpose to develop skills to carry out duties in time of war, which are additional to its core duties in humanitarian affairs.
Article 3
(1) In order to be able to carry out the provisions of Article 2 above, the PMI shall seek to maximize the Indonesian people's participation in terms of personnel and funds.
(2) Every year, the PMI shall submit to the Government its plan of action for the next year and its activity report for the preceding year. The plan of action and activity report shall be submitted to the Government by 1 April every year.
Article 4
(1) For the implementation of the provision of Article 1(3) above, the Coordinating Minister for Defense/Security shall develop a division of roles and rights between the Armed Forces and the PMI by taking into consideration the provisions of the Geneva Conventions.
(2) The division of roles and rights shall be in enough detail for a distinction to be made between wartimes and peacetimes.
Article 5
For the implementation of the provision of Article 2(2), the Coordinating Minister for Welfare shall develop a division of roles and rights between the ministries under its coordination and the PMI, by taking into consideration the rules issued by the Red Cross League.
Article 6
For the implementation of the provision of Article 3(1), the PMI must obtain prior authorization from the Deputy Prime Minister, particularly when fundraising activities are concerned.
CHAPTER III
CONCLUDING PROVISIONSArticle 7
Except for the matters that are already regulated in this Decree, the Deputy Prime Minister shall develop regulations on all red cross-related matters by keeping in mind/hearing considerations from the PMI Central Leadership.
Article 8
This Decree takes effect as from the date it is stipulated.
