Decree No. C.33.PR.09.03 of 1996 concerning the establishment of the Permanent Committee on the implementation and research of International Humanitarian Law

THE MINISTER OF JUSTICE OF THE REPUBLIC OF INDONESIA

Considering:

    a. that the frame time duty of the Permanent Committee on the Implementation and Research of International Humanitarian Law for the period of 1995-1996, based on the Decree of the Minister of Justice of the Republic of Indonesia Number : C-57.PR.09.03 of 1995 dated July 31 of 1995, has been terminated;

    b. that for continuing the duties of the Permanent Committee on the Implementation and Research of International Humanitarian Law as stipulated in Decree of the Minister of justice of the Republic of Indonesia Number : M.01.PR.09.01-1980 dated January 2 of 1980, it is necessary to appoint the new members of the Committee;

    c. that those who are mentioned in this Decree are considered to be able to implement the duties concerned.

In view of:

1. The Act Number 2 of 1996 concerning State Budget for the period of 1996-1997;

2. The Presidential Decree Number 16 of 1994 concerning the Implementation of State Budget as revised by the Presidential Decree Number 24 of 1995;

3. The Presidential Decree Number 96/M/1993 concerning the Formulation of the Sixth Development Cabinet;

4. The Presidential Decree Number 227/M/1995 concerning the Appointment of the Director General of Law and Legislation;

5. The Decree of me Minister of Justice Number M.01.01.1980 concerning the Establishment of the Permanent Committee on the Implementation and Research of International Humanitarian Law;

6. The Decree of the Minister of Justice Number M.02-PR.07.10 of 1989 concerning the Organizational and Working Order of the Department of Justice.

DECIDES :

To stipulate :

FIRST : to establish the Permanent Committee on the Implementation and Research of International Humanitarian Law for the period of 1996-1997 which consists of:

1. Budiarti, SH (Department of Justice) - as the Chairperson.
2. Risma Indriyani, SH (Department of Justice) - as the Secretary.
3. Rahimi Nahar, SH (Department of Justice) - as member.
4. Aida Soegiharto, SH (Department of Justice) - as member.
5. K. Suparlan, SH (Department of Justice) - as member.
6. Zulkarnaen Yunus, SH., MH (Department of Justice) - as member.
7. Abdul Wachid, SH (Department of Justice) - as member.
8. Dr. H. Soesanto Mangoensadjito (Sec.Gen of PMI) - as member.
9. Nasri Darwis, SH (Department of Internal Affairs) - as member.
10. Raztaty Tanzil, SH (Department of Foreign Affairs) - as member.
11. Sadewo Yoedo, SH (Department of Foreign Affairs) - as member.
12. Kol. Chk. M. Panjaitan, SH (Head quarter of ABRI) - as member.
13. Letkol.Chk.(K)Sri Nurul R, SH.,LLM (Dept.of Defense) - as member.
14. Edwin Lomban, SH (Department of Justice) - as member.
15. Drs. Tjahyo Samawi (Department of Justice) - as member.

SECOND : The duties of the Committee are :

    a. to implement the duties of the Permanent Committee as mentioned in Article 2 and Article 3 of Decree of the Minister of Justice Number M.01.PR.09.01-1980 concerning the Establishment of the Permanent Committee on the Implementation and Research of International Humanitarian Law;

    b. to submit the report concerning the implementation of the duties mentioned above, to the Minister of Justice through the Director General of Law and Legislation.

THIRD : The Committee is assisted by :

    a. 3 (three) persons of the advisers :

      1. Marshall (ret.) Suwardi Martowirono, SH (Judge of the Supreme Court)
      2. Brig. Gen. (ret.) GPH. Haryomataram, SH (National Resilience Institution)
      3. Boedi Harsono, SH., MIL.

    b. 3 (three) persons of secretariat staff:

      1. Hendi Santosa, SH (secretariat staff)
      2. Pudji Hastuti (secretariat staff)
      3. Arie Sunaryono (secretariat staff)

FOURTH : The Committee shall function for 12 months.

FIFTH : All expenses related to the duties implementation of the Committee will be borne by the Regular Budget of the Directorate General of Law and Legislation of 1996-1997 DIK Number 030/13/96 dated April 1 of 1996.

SIXTH : This Decree shall come into force as from April 1 of 1966.
