Prime Minister Resolution regarding the establishment of the National Commission for International Humanitarian Law

Prime Minister Resolution No (32)
For the year 2004
Regarding the establishment of the National Commission for International Humanitarian LawThe Council of Ministers,
Having reviewed the Constitution,
The Federal Law No (1) of 1972 regarding the jurisdiction of ministries and competences of ministers, and the laws amending it;
The Federal Law No (45) of 1992 regarding the organization of the Ministry of Foreign Affairs;
The Federal Law No (9) of 2004 regarding the adherence of the Unite Arab Emirates to the Two Additional Protocols to the Four Geneva Conventions of 1949;
And Prime Minister Resolution No (3/615) of 2004, regarding the approval of the establishment of the National Commission for International Humanitarian Law (IHL); and
According to what has been presented by the Deputy Prime Minister, State Minister for Foreign Affairs, and the approval of the Council of Ministers, it has been decided:
Article (1)
A permanent commission called "The National Commission for International Humanitarian Law" shall be established, whose competences shall be as follows:
1- Reinforce the implementation of IHL provisions, including coordination between competent authorities within the State;
2- Review legislation relevant to IHL and present recommendations regarding them;
3- Collect data and statistics related to State contributions in this respect;
4- Consolidate cooperation and exchange of expertise with unions, associations and organizations working in the domain of international humanitarian law;
5- Put forth plans and programs of training; organize seminars to disseminate IHL and raise awareness concerning its provisions;
6- Undertake any tasks assigned to the Commission by the Council of Ministers or any specialized bodies within the State.
Article (2)
The National Commission shall be presided over by the Deputy Prime Minister, State Minister for Foreign Affairs, or his deputy. It shall include in its membership representatives of:
- The Ministry of Foreign Affairs;
- The Ministry of Interior;
- The Ministry of Justice, Islamic Affairs and Endowments;
- The Supreme Command of the Armed Forces;
- State Security Service;
- The Red Crescent Society.
The Commission can form sub-groups among its members to undertake specific tasks within the competence of the National Commission. It can also seek support from suitable advisors and experts.
Article (3)
The Commission shall convene, upon the initiative of its president, whenever the need arises. The Commission meeting shall not be valid unless half of its members, including the President of the Commission, attended it.
Article (4)
The Red Crescent Society shall assume the tasks of the General Secretariat of the National Commission as follows:
- Prepare a draft agenda for the Commission;
- Carry out the necessary procedures to implement the resolutions and recommendations of the Commission and follow them up;
- Collect legislation, data and information related to IHL.
Article (5)
The remunerations of the President, members of the Commission, advisors and experts shall be decided according to the rules in force within the State.
Article (6)
The President of the National Commission shall issue the necessary decisions to implement the provisions of this Resolution.
Article (7)
The Minister of Foreign Affairs and the competent authorities shall strive to implement this Resolution; it shall be issued in the official paper and shall enter into force as from the date of its issuance.
