Relatoría para la libertad de expresión de la CIDH lamenta muerte de periodista en México y solicita debida investigación

La Relatoría Especial para la Libertad de Expresión de la Comisión Interamericana de Derechos Humanos (CIDH) de la OEA lamenta la muerte del camarógrafo estadounidense Brad Will, ocurrida en Oaxaca, México. La Relatoría Especial insta a las autoridades mexicanas a investigar este hecho de manera rápida y eficaz para que se sancione debidamente a sus responsables y se determinen las circunstancias de su muerte.
De acuerdo a la información recibida por la Relatoría Especial, el 27 de octubre de 2006 el señor Brad Will fue herido de bala mientras filmaba un enfrentamiento entre simpatizantes de la Asamblea Popular de los Pueblos de Oaxaca (APPO) y la policía local. El documentalista y reportero gráfico, quien cubría el conflicto en Oaxaca para la organización de medios independientes Indymedia, murió cuando era trasladado a un hospital. Según la información recibida, los disparos habrían provenido de policías municipales vestidos de civil y personal de la alcaldía, quienes habrían abierto fuego contra una barricada de la APPO cerca de la cual se encontraba el señor Brad Will.
El Relator Especial para la Libertad de Expresión, Ignacio J. Álvarez, señaló que "este hecho pone una vez más de manifiesto la vulnerabilidad de la situación de los periodistas en el ejercicio de sus tareas, vitales para la existencia y desarrollo de una sociedad informada. Es lamentable y deplorable que un camarógrafo que intentaba recoger imágenes de un hecho noticioso de interés nacional e internacional haya caído muerto durante la balacera. Urgimos a las autoridades locales y nacionales a que investiguen adecuadamente este crimen, que determinen si el asesinato del señor Brad Will fue consecuencia de su oficio periodístico, y que se lleve a los tribunales a los responsables de este hecho. La falta de una investigación efectiva puede hacer a los Estados incurrir en responsabilidad internacional determinada por la Comisión Interamericana de Derechos Humanos y por la Corte Interamericana de Derechos Humanos".
La Relatoría Especial para la Libertad de Expresión recuerda que conforme a la Convención Americana sobre Derechos Humanos, los Estados tienen el deber de prevenir, investigar y sancionar toda violación de los derechos allí reconocidos. El Principio 9 de la Declaración de Principios sobre la Libertad de Expresión de la CIDH señala que "el asesinato, secuestro, intimidación, amenaza a los comunicadores sociales, así como la destrucción material de los medios de comunicación, viola los derechos fundamentales de las personas y coarta severamente la libertad de expresión. Es deber de los Estados prevenir e investigar estos hechos, sancionar a sus autores y asegurar a las víctimas una reparación adecuada".

Office of the Special Rapporteur for Freedom of Expression Regrets Death of Journalist in Mexico and Calls for Appropriate Investigation
The Office of the Special Rapporteur for Freedom of Expression of the Inter-American Commission on Human Rights (IACHR) of the OAS regrets the death of U.S. cameraman Brad Will in Oaxaca, Mexico. The Office of the Special Rapporteur urges the Mexican authorities to investigate this occurrence promptly and effectively in order to determine the circumstances of the death and duly sanction those responsible.
According to the information received by the Office of the Special Rapporteur, on October 27, 2006, Mr. Brad Will was injured by gunshots while he was filming a confrontation between sympathizers of the Popular Assembly of the People of Oaxaca (Asamblea Popular de los Pueblos de Oaxaca, APPO) and the local police. The documentarian and photojournalist, who was covering the conflict in Oaxaca for the independent media organization Indymedia, died when he was transferred to a hospital. According to the information received, the shots allegedly came from municipal police dressed in civilian clothing and personnel of the mayor’s office, who opened fire against an APPO barricade near Mr. Brad Will.
The Special Rapporteur for Freedom of Expression, Ignacio J. Álvarez, stated that "this act once again shows the vulnerability of the situation of journalists in carrying out their work, vital for the existence and development of an informed society. It is lamentable and deplorable that a cameraman who was attempting to gather images of a news story of national and international interest died during the shooting. We urge the local and national authorities to investigate this crime adequately, to determine whether the murder of Mr. Brad Will was a consequence of his work as a journalist, and to bring those responsible for this act before the courts. The lack of an effective investigation may cause the States to incur international responsibility determined by the Inter-American Commission on Human Rights and the Inter-American Court of Human Rights."
The Office of the Special Rapporteur for Freedom of Expression recalls that according to the American Convention on Human Rights, the States have the duty to prevent, investigate, and sanction any violation of the rights recognized therein. Principle 9 of the Declaration of Principles of the IACHR states that "[t]he murder, kidnapping, intimidation of and/or threats to social communicators, as well as the material destruction of communications media violate the fundamental rights of individuals and strongly restrict freedom of expression. It is the duty of the State to prevent and investigate such occurrences, to punish their perpetrators and to ensure that victims receive due compensation."
